NuVasive MAGEC Lawsuit

Scoliosis is an abnormal sideway curvature of the spine which affects more than 100,000 children each year. Early onset scoliosis usually develops in children before the age of 8. The typical treatment for severe scoliosis requires children to undergo surgery to implant growing rods. These rods must be surgically removed and replaced numerous times as the child grows. Sadly, this leads to multiple surgeries, complications and the inherent risks associated with general anesthesia.

What is the MAGEC System?

The MAGEC (Magnetic Expansion Control) System by NuVasive was touted as a safer option due to its ability to eliminate the need for multiple surgeries. The MAGEC was a magnetically controlled rod that could be lengthened in a doctor’s office thereby reducing the number of surgeries a young child would have to endure. However, on February 13, 2020, NuVasive voluntarily recalled its Magec System Model X rods due to serious potential complications including titanium metallosis, necrosis (tissue death), implant failure, and potentially multiple unplanned and painful revision surgeries.

A 2020 study also acknowledged that the MAGEC system is associated with significant titanium wear and metallosis, as well as a high rate of implant failure requiring unplanned revision surgeries. Metallosis can result in inflammation, pain, and swelling in the surrounding tissue. This not only causes discomfort but may even lead to premature failure of MAGEC rods as well as tissue, muscle and bone death. These complications have not been seen with traditional growth rods.
